Delhi High Court has granted 30 days interim bail to a prisoner after he was accused of assault by officials in Tihar Jail. The medical report has confirmed a fracture in the prisoner’s hand. The prisoner is serving life imprisonment in a POCSO case.
New Delhi [भारत]July 29 (ANI): The Delhi High Court on Wednesday granted 30-day interim bail to a Tihar Jail inmate who had accused jail officials of assault. This prisoner is serving life imprisonment in a POCSO case.
The High Court granted interim bail after the medical report of Deen Dayal Upadhyay Hospital, which stated that prisoner Ashish alias Vicky had suffered a fracture in his hand.
The division bench of Justices Pratibha M Singh and Vikas Mahajan granted interim bail for 30 days on a bail bond of Rs 10,000 and one surety bond of like amount. After perusing the report and medical report filed by the jail authorities, the bench said, “We need to study these reports; in the meantime, we are granting interim bail to prisoner Ashish alias Vicky.”
The bench has adjourned the matter to September 23 for appropriate directions and further hearing. Head Warden Sagar also appeared before the court and filed his personal affidavit. Advocate Digant Mishra appeared on behalf of the applicant.
What is the whole matter?
Earlier, on July 17, the Delhi High Court had sought response from jail authorities on allegations of custodial assault by three prisoners, including a convict. The High Court had also directed the head warden, against whom there were allegations of assault, to be present on the next date.
It is alleged that the head warden had beaten the accused Ashish alias Vicky for not fulfilling the demand of protection money of Rs 15,000. It is also alleged that Ashish was assaulted on June 26. The CCTV footage of the date of the incident has been preserved and presented in the court along with the report in a sealed cover as directed by the bench.
The jail authorities were directed to get the prisoners examined and treated at Deen Dayal Upadhyay Hospital, and the jail medical officer was directed to file the medical report on the next date of hearing.
Advocate Digant Mishra appeared for Ashish alias Vicky and argued that the petitioner and two other prisoners were beaten 15 days ago. He had further said that he was beaten up for not fulfilling his demand for protection money. It was also argued that medical treatment was not given to the prisoners by the jail staff.
Additional Public Prosecutor (APP) Ritesh Bahri, appearing for the state, argued that these were normal incidents. One prisoner was even killed by other prisoners. A medical report should be called for. On this the High Court had said that this is not normal. Such incidents should be dealt with strictly. It also said that in the case of two other prisoners, the trial court had directed to preserve the CCTV footage. (ANI)
