CJI Surya Kant Ultimatum: The impact of closure of many metro stations due to security reasons amid student protests in Delhi has now reached the Supreme Court of the country. On Thursday, Chief Justice of India (CJI) Surya Kant clearly indicated that if the situation does not return to normal by lunch, he will intervene himself. The comments came when the Supreme Court Bar Association (SCBA) told the court that the closure of several stations, including the Supreme Court Metro station, was causing immense hardship to lawyers, parties and court staff.

SCBA President Vikas Singh said in front of the bench headed by CJI that due to closure of many stations of Delhi Metro, it has become difficult to reach the court. He suggested that lawyers, registry staff and authorized people who have valid proximity cards or identity cards be allowed to exit the Supreme Court Metro station after security check. His argument was that only authorized people can be allowed to come out after doing security check at the metro station itself, so that security is maintained and judicial work is also not affected.

In view of this grave crisis, senior advocate Vikas Singh, President of the Supreme Court Bar Association (SCBA), immediately raised this emergency situation before the bench headed by Chief Justice of India (CJI) Surya Kant. Vikas Singh told the court that due to the closure of the metro station, it has become impossible for lawyers and litigants to reach the Supreme Court premises. Taking cognizance of this, CJI Surya Kant took a tough stand and gave a direct ultimatum to the administration. The CJI said in a harsh tone, “I had told him in the morning itself. It is up to him to talk to the officials. If a solution is found by lunch time, then it is fine. Otherwise, if my intervention is needed, I will intervene myself.”

In view of the absence of lawyers and people associated with the cases due to the closure of the Metro, the Chief Justice issued a big and relief direction. CJI Surya Kant gave a clear order to all the concerned courts that no ‘adverse order’ should be passed against the lawyers who are not able to reach the court room on time due to the current situation and metro restrictions. This humanitarian and strict step brought great relief to hundreds of lawyers who were stuck outside the closed roads and metro of Delhi and were afraid of their cases being rejected.

In such a situation, lawyers, registry staff and officers who have valid ‘proximity cards’ or official identity cards of the Supreme Court should be given special permission to come out from the exit point of the Supreme Court Metro station after thorough security check. Common passengers or protesters can be kept inside the train and sent to further stations. Appreciating this suggestion, the CJI said that the Supreme Court administration is already talking to the top officials of Delhi Metro on this formula.
