What is fast-track court?
Fast-track courts are courts whose purpose is to hear selected cases more quickly than normal courts. In these courts, priority is given to those cases in which justice can be delayed due to prolonged litigation. Fast-track courts have been used from time to time in India for speedy disposal of rape, crimes against women and children, cases involving public interest and other serious crimes.
How does Fast Track Court work in India?
- Special Courts: Fast track courts are created to hear serious and priority cases faster than normal courts.
- Priority Hearing: In these courts, selected cases are heard continuously and on priority basis, so that the decision can be reached quickly.
- When did it start? The Central Government started Fast Track Courts for the first time in the year 2000 with the aim of reducing the burden of pending cases.
- Which cases are heard? From time to time, these courts have also been constituted to hear cases of rape, crimes against women and children (POCSO), senior citizens and other sensitive cases.
- Who operates? Fast Track Courts are constituted and operated by state governments in consultation with the respective High Courts. The appointment of judges for these is also done under the judicial process.
- Is it necessary to take a decision within stipulated time? No. The objective of fast track courts is speedy disposal of cases, but the law does not prescribe a uniform and mandatory time limit for every case. The decision depends on the progress of investigation, evidence and hearing.
What will happen in cases of paper leak?
If the government brings paper leak cases under the ambit of fast-track courts, then such cases can be heard on priority basis. Its objective will be that after the completion of the investigation, the case does not remain pending for years and the verdict against the culprits comes soon. However, any accused can be punished only when sufficient and legally acceptable evidence is presented against him in the court. Therefore, mere creation of a fast-track court does not ensure immediate punishment.
How soon can those who leak papers be punished?
At present, the government has announced the creation of a fast-track court, but has not told whether any specific time limit will be fixed for the disposal of paper leak cases. Therefore, it is not possible to say right now whether an accused will be punished within 3 months, 6 months or one year. The duration of the hearing will depend on many things, such as-
- How quickly the police or investigating agency completes the investigation.
- When is the charge sheet filed?
- How many accused are there in the case?
- Number of witnesses and digital evidence.
- Progress of hearing in court.
Will paper leaks be stopped only by fast-track courts?
Experts believe that speedy trial can be an important step, but it will also need to be accompanied by strong investigation, secure examination system, digital surveillance and effective prosecution against the culprits. Only then can organized crimes like paper leaks be effectively stopped.
What will be the benefit to the students?
If the cases are disposed of quickly, action against the culprits will be expedited and a strong message will be sent to those who commit such crimes in future. This can also help in increasing the credibility of recruitment and entrance examinations. The Prime Minister’s announcement has clearly indicated that the government wants to take steps towards speedy justice in paper leak cases.
