The United States is moving to formalise sweeping changes to its EB-5 Immigrant Investor Program, with the Department of Homeland Security (DHS) releasing a proposed rule that tightens oversight, clarifies investment requirements, and updates how Regional Centres operate.
The proposal will be open for public comments for 60 days after its publication in the July 2 edition of the Federal Register. Once reviewed, the rules could become final within a few months.
What This Means for EB-5 Investors
India remains one of the fastest-growing markets for the EB-5 investor visa, making these changes especially relevant for wealthy Indian families seeking permanent residence in the US.
The proposal does not introduce a brand-new visa category. Instead, it converts many provisions of the EB-5 Reform and Integrity Act of 2022 into formal regulations while adding more clarity on investment, compliance, and documentation.
