TCS, the country’s biggest IT company, is in the headlines these days due to a serious controversy. Allegations of religious conversion and sexual harassment related to the campus in Nashik, Maharashtra have now taken a legal turn. The matter has now reached the Supreme Court and its investigation has started at several levels. A petition has been filed in the Supreme Court on behalf of lawyer Ashwini Kumar Upadhyay through his lawyer Ashwini Dubey regarding this entire matter. The petition demands that the Central and State Governments take strict action on such cases, especially in situations where allegations of conversion through fraud or pressure come to the fore.

Petition claims: Freedom of religion versus limitations

The petition states that the Constitution gives freedom to believe, practice and propagate religion, but this right is not completely unlimited. In this, conditions like public order, morality and health apply. It has been argued that no person can do any kind of activity in the name of religion. If this freedom is given without any restrictions, it can become a challenge to social balance and national unity.

Why is the issue of “fraudulent conversion” arising?

The petition especially emphasizes that if religious conversion is done through deception, pressure or wrong information, then it is not only a personal matter, but it also impacts the society and law and order. Supreme Court’s earlier stand is also under discussion

Earlier in 2023, the Supreme Court had said that issues like religious conversion cannot be taken lightly and giving it a political color is also not right. The court heard Attorney General R. Venkataramani’s assistance was also sought so that its legal aspects could be understood better.

NCW’s entry: investigation in Nashik on April 18

Now the National Commission for Women has also played an active role in this matter. Taking suo motu cognizance, the Commission has constituted a fact-finding committee, which will go to Nashik on April 18 and investigate. This team will go to the spot and talk to the victims, police officers, company representatives and other concerned people. It will also be seen whether there is any deficiency in the investigation or security arrangements.

TCS’s response: Claim of ‘zero tolerance policy’

Tata Consultancy Services has responded to these allegations saying that the company adopts a strict policy against any kind of harassment and pressure at the workplace. According to the company, as soon as they got information about this matter, action was immediately started internally and the entire matter was taken seriously.

Now eye on further investigation and Supreme Court

At present this matter is in the initial stage of investigation and legal process. On one hand the NCW team will prepare its report, while on the other hand this petition is to be heard further in the Supreme Court. Now everyone’s eyes are on what comes out in the investigation and what stance the court takes on this entire matter.
