Som Distilleries License Renewal Case: Renewal not an automatic right

The State Government believes that along with promoting industrial development and investment, fair and strict compliance with the law is also necessary. In the order issued by the Excise Commissioner, it has been made clear that renewal of any license is not an automatic right.

Before renewal, a thorough review of the entire conduct of the organization, adherence to legal provisions, compliance with license conditions, regulatory eligibility, authenticity of documents and all aspects related to public interest is done. Under this process, a detailed study of Madhya Pradesh Excise Act 1915, its related rules, available records and court instructions was done.

Cases related to illegal liquor transport and rule violation reviewed

During the investigation of the case, many old cases related to the concerned group were also taken into consideration. These include cases related to transportation of illegal liquor, use of allegedly forged permits, loss of government revenue and violation of excise laws. The overall conduct and legal compliance of the concerned institution was reviewed by examining available documents, investigation reports, evidence and court records. After this it was decided to cancel the renewal application.

High Court Observation: High Court had also laid emphasis on independent trial

This matter was also pending in the High Court. The court had said in its order that cases related to license renewal should be examined in an independent and reasoned manner on the basis of available facts, legal provisions and conduct of the party concerned. The court did not give any party the automatic right to renew the license. In accordance with this legal approach, the final decision was taken after examining the case by the competent authority.

Transparent Governance: Emphasis on transparent governance with development

Chief Minister Dr. Mohan Yadav has made it clear that along with encouraging investment and industries in the state, it is the priority of the government to ensure transparent, accountable and rule-based administration. The government wants to create an environment where rule-abiding industries and honest entrepreneurs are encouraged, while strict action is taken against those who act against the law and public interest.

Zero Tolerance Policy: Strict action will be taken against those who break the rules

Under the leadership of the Chief Minister, the State Government is continuously taking steps to strengthen transparency, accountability and legal discipline in the administrative system. The government believes that all decisions should be taken in accordance with the law and keeping public interest paramount.

This decision taken in the case related to Som Distilleries is being considered an important example of the government’s “Zero Tolerance Against Illegal Activities” policy. This decision gives a clear message that strict action will be taken against any institution or person violating the law in Madhya Pradesh and no one will be considered above the law.
