The court has termed this crime as ‘heinous’. The landmark judgment has created a huge political wave, with prominent leaders demanding a permanent fast-track mechanism to deliver justice within a strict time-frame of four months for crimes against women and children.

Leaders demanded fast-track court

Congress leader Nana Patole and party MLA Aslam Shaikh on Monday demanded fast-track trials and stringent punishment in cases of crimes against women and children after a Pune court awarded death sentence to a man convicted of raping and murdering a three-year-old girl in Nasrapur. Responding to the matter, Patole said that those accused of torturing women should be tried in fast-track courts. “Cases against persons who commit atrocities on women should be heard in fast-track courts. Immediate action should be taken against them because only then will the society be safe,” he said.

Congress MLA Aslam Shaikh also demanded speedy hearing in such cases and said that decisions should be given within four months. Sheikh said, “Such incidents, especially rape and murder cases involving innocent children, should be handled by fast-track courts. Judgments should be pronounced and action taken within four months, and the harshest punishment should be given.”

Earlier in the day, Maharashtra Deputy Chief Minister Eknath Shinde welcomed the death sentence. On Monday, a special court in Pune awarded death sentence to a 65-year-old man found guilty of rape and murder of a three-year-old girl in Pune district, describing the crime as “heinous”. The convict has been identified as Bhimrao Kamble, who was found guilty of rape and murder of a minor in Nasrapur village. This incident happened on May 1. After this incident, the case was heard in the fast-track court.

Death sentence given as heinous crime

While pronouncing the sentence, the special court said that the nature of the crime was heinous and held that the gravity and motive of the crime were sufficient to award the death penalty. On June 25, the Pune Court delivered a verdict of guilty, confirming that the prosecution had successfully proved beyond reasonable doubt all charges against the accused. Following the court’s finding that the accused was guilty under all relevant sections of the Indian Code of Justice, the proceedings proceeded to the sentencing stage. After hearing the arguments of both the prosecution and the complainant side, the court had fixed today for the final decision on the sentence.

Special Public Prosecutor Advocate Ajay Misar said that the prosecution team gave priority to the seriousness of the crime throughout the trial. Misr said, “Today the case was put up for final judgment. The court pronounced its verdict. In this judgement, the prosecution concluded that all the charges against the accused were proved beyond reasonable doubt. The court concluded that the accused was guilty under all sections of the IPC and declared him guilty.”

The prosecution argued 12 decisions

To emphasize the demand for maximum possible punishment, the prosecution cited 12 landmark judgments of the Supreme Court which have discussed the need for capital punishment and death penalty for heinous crimes involving minors. Advocate Miser said of the judicial reception of their arguments, “The prosecution cited in the court 12 landmark judgments of the Supreme Court that debated the necessity of capital punishment and capital punishment for such crimes, and the court agreed.”

He further said, “Subsequently, the complaining party presented its arguments, and after hearing all these arguments, the court adjourned the case to Monday, the 29th, for a verdict on the sentence.” (ANI)
