Azam Khan Jauhar University: Order for demolition action has been issued on 38 buildings of Azam Khan’s Mohammad Ali Jauhar University in Rampur. Rampur Development Authority took a big decision citing construction without approved map.

Rampur Jauhar University Demolition: Senior Samajwadi Party leader Azam Khan’s Mohammad Ali Johar University is once again in the news. This time the matter is regarding the buildings constructed in the university campus. Rampur Development Authority (RDA) after investigation and hearing has issued orders for demolition of 38 buildings of the university considering them as illegal construction. The authority says that necessary construction approval was not taken from the competent authority for these buildings.

After investigation, RDA issued demolition order

According to Rampur District Magistrate Ajay Kumar Dwivedi, Mohammad Ali Jauhar University was also inspected as part of the campaign against illegal constructions in the district. On the basis of the report of the Regional Sub Engineer, a notice was issued to the university administration and an opportunity was given to present its stand.

The university filed a written reply on July 8, while a personal hearing took place on July 15. During this, the university management, Rampur Development Authority officials and advocates from both the sides presented their arguments. After reviewing all the documents and arguments, the demolition order was issued under Section 27(1) of the Uttar Pradesh Town Planning and Development Act, 1973.

What did the university say, why did RDA reject the argument?

During the hearing, the university administration said that village Singankheda was not included in the development area of ​​Rampur Development Authority before 27 September 2024. Therefore, at that time there was no compulsion to get the map approved by RDA. It was also said that most of the constructions are old, hence they cannot be considered illegal on the basis of current rules.

However, Rampur Development Authority did not accept these arguments. The order said that it was mandatory to obtain permission from the concerned competent authority at the time of construction, whether the area is later included within the limits of the development authority or not. During investigation, only the maps of the Medical College and Academic Block were found to be approved in the records of the District Panchayat, while no valid approval was available for the remaining 38 buildings.

Only two buildings were approved

DM Ajay Kumar Dwivedi said that the investigation also made it clear that the university management was aware of the process of construction approval. The proof of this is that due permission was taken for the medical college and academic block, while the other 38 buildings were constructed without approval.

The authority said in the order that the basis of validity of the building is the approval received from the competent authority as per the law applicable at the time of construction. If construction is done without permission then it cannot be considered legal. On this basis, the way for further action under Section 59 has also been kept open.
