Joshiba told that when she asked her friend for the money back, the friend challenged her right in her face. The friend said, ‘Go and file a case.’ Go to court. I will not give your money back. Joshiba says that maybe her friend is really going through financial crisis, but I am also in trouble and am demanding my own money back.

As a lawyer, Joshiba says that a legal battle will have to be fought in this matter for years, but still there is no guarantee of getting the money back. That’s why he decided not to file the case. According to him, a case may take two to three years to be resolved. Even if the decision is in my favor in the third year, and at that time also my friend’s financial condition worsens or he declares himself bankrupt, what will I do?

He further explained that to recover money through legal action, it has to be proved that the other party has some asset or source of income. No one can be forced to give too much money. Proving someone else’s financial status is a big challenge. I have to prove she has investments, a house, or travels. Collecting all this information is a huge task.

Joshiba said, ‘If the amount was more than Rs 10 lakh, then perhaps there would have been some point in filing a case, because at least Rs 5 lakh would have been recovered from it. But when there are already 4.9 crore cases pending in the courts, working so hard to recover just Rs 2.5 lakh is a loss.

She said, ‘I am taking it as a lesson. From now on, I will give only that much money to my friends, which I will not regret even if I go bankrupt. Many people have commented on this post.
