The Supreme Court has declared the Uttar Pradesh Madrasa Education Board Act 2004 as constitutional. Along with this, the court also rejected the March 22 decision of the Allahabad High Court, in which the UP Madarsa Act was repealed. Besides, the Supreme Court has also said that the UP Madarsa Board cannot recognize the madrassas which give Kamil and Fazil certificates beyond class 12th, because these are contrary to the UGC Act. Let us know what is the degree of Kamil and Fazil and what is the education system of madrassas?

First of all, let us know what is the whole matter? In the year 2004, a law was made regarding Madrasas in Uttar Pradesh, under which Madrasa Board was formed. Its purpose was to organize madrassas. There are about 23500 madrassas in UP, out of which 16513 madrassas are recognized by the board, out of which 560 madrassas are aided, while about 8500 madrassas are not recognized.

High Court had given this decision

On March 22, the Allahabad High Court had declared the UP Madrasa Act unconstitutional and violating the principle of secularism. Besides, instructions were given to send the children studying in these madrassas to formal schools. After which this order of Allahabad High Court was challenged in the Supreme Court.

What did SC say in the decision

The Supreme Court, while giving a big decision in this matter today i.e. on Tuesday, overturned the decision of the Allahabad High Court and declared the Madrasa Education Board Act 2004 as constitutional. The Supreme Court has said in its decision that the UP Madarsa Act is not a violation of the fundamental rights and basic structure of the Constitution. Education Quality Rules do not interfere in the administration of madrassas. Also, SC has said that UP Madrasa Board cannot give degrees to Fazil and Kamil.

What is the degree of Kamil and Fazil?

Kamil and Fazil degrees are given to those students studying in madrassas who have attained Aalim. Shahi Imam of Lucknow Eidgah, Maulana Khalid Rashid Firangi Mahali said that Fazil is equivalent to Graduation (UG) and Kamil is equivalent to Post Graduation (PG). He told that the education system of madrassas is like the general education system of the country. In Madrasas, education is imparted like primary, secondary, senior secondary or graduation. Although the names of each division in madrassas are different, they also include English, Science and worldly studies.

From which madrassas one gets the degree of Kamil-Fazil?

Maulana Khalid Rashid Firangi Mahali said that Madrasas get recognition from the Madrasa Board at Tahtania, Faukania, Aliya level. Among these, the level of Tahtania is considered to be primary, the level of Faukania is considered to be junior high school and Aliya is considered to be further education. Kamil and Fazil degrees have been given only in Aliya level madrassas. In these madrassas, the degree of Munshi/Maulvi is considered equivalent to 10th and Alim degree is equivalent to 12th.
