‘Unconstitutional’: Sibal slams ONOE panel’s planned visit to SC

Former Union Minister Kapil Sibal has deemed the proposed visit of the ‘One Nation, One Election’ panel to the Supreme Court for discussions as ‘unconstitutional,’ stating that it violates the principle of separation of powers.

Former Union Minister and Rajya Sabha MP Kapil Sibal on Thursday said that he has learnt of the proposed visit of the panel examining the One Nation, One Election bill to the Supreme Court and any such move for the discussion on the bill is “unconstitutional.”

Sibal Slams ‘Unconstitutional’ Move

Sibal, addressing a press conference, said that the Constitution provides a clear separation of powers and the court decides on the constitutionality of a bill passed by the Parliament. Sibal said that he had learnt that a programme has been circulated of a local study visit program of the ONOE panel to the Supreme Court on October 6, 2026. He said that the agenda included an informal discussion on the issue of simultaneous elections. “I have never heard in the history of India till date that a parliamentary group holds a meeting in the Supreme Court regarding a law (One Nation One Election), to tell the Supreme Court judges what this law actually is. I am talking about ‘One Nation One Election’… I have never heard of such a thing in my legal career. This is unconstitutional,” he said.

Visit Reportedly Cancelled

Report said that the panel has cancelled its programme of visiting the Supreme Court.

About the ‘One Nation, One Election’ Framework

The Constitution (One Hundred and Twenty-Ninth Amendment) Bill, 2024, is linked to the proposed reform popularly known as “One Nation, One Election,” which seeks to synchronise elections for the Lok Sabha and state legislative assemblies.

The Union Territories Laws (Amendment) Bill, 2024, is also part of the broader framework aimed at facilitating the implementation of simultaneous elections across the country. (ANI)
