US President Donald has once again suffered a setback in the matter of tariffs. The US Trade Court has also declared the 10 percent tariff imposed by Trump illegal. Earlier, the Supreme Court had declared Trump’s tariffs unconstitutional. However, the court has banned tariffs only for two private importers and Washington state.
A three-judge panel of the Court of International Trade in New York ruled in a 2-1 decision that the 10% tariffs were illegal following a lawsuit brought by small businesses, the Associated Press reported. The court said that Trump has violated the authority given to the President by Congress under the law. Along with this, the court called the tariff “invalid” and “unauthorized”. Currently, the court’s decision directly stops the collection of tariffs from Washington State and two companies, spice company Burlap & Barrel and toy company Basic Fun.
The dispute is over the temporary 10% global tariff imposed by the Donald Trump Administration in February after the Supreme Court overturned the huge double-digit tariffs imposed on almost every country last year. The new tariffs, imposed in February, were implemented under Section 122 of the Trade Act of 1974 and are set to expire on July 24. A hearing was held in the court regarding this. However, the court has refused to accept the proposal not to impose tariffs on the remaining 24 importers. Currently only 3 importers have been exempted from this.
What can happen next?
Jeffrey Schwab, senior attorney at the Liberty Justice Center, which fought the case on behalf of small businesses, said further action would depend on what action the Trump administration takes and whether the US Justice Department appeals the decision. At the same time, Basic Fun Inc. is among the companies filing the case. CEO Jay Foreman welcomed the court’s decision. He said that it takes great courage for a small business to fight a legal battle like this. According to Foreman, his company has so far paid more than $1 lakh under the disputed tariff.
What was the decision of the Supreme Court
Earlier, the US Supreme Court had termed the arbitrary tariff rates imposed by President Trump as illegal, after which Trump had devised a tariff plan of 10 percent. This historic decision of the Supreme Court came by 6-3. The court had said at that time that Trump was the first President who imposed tariffs on more than 100 countries citing an emergency law of the 1970s. Not only this, he also made trade deals with many countries by threatening tariffs. The word ‘tariff’ is not mentioned anywhere in this law. Therefore the court had declared it unconstitutional.
