In the Gyanvapi case in Varanasi, Uttar Pradesh, the petition filed for survey of the entire complex was rejected due to the weak arguments of the Hindu side. While giving the verdict, Judge Yugal Shambhu, who is hearing the case, said that the 839-page ASI survey report is yet to be investigated. A complete conclusion can be drawn on this only after observation. Apart from this, the court also took into consideration some important points.
This petition was filed on behalf of the Hindu side on 8 April 2021. The petition said that along with the 100 feet giant Shivalinga built under the dome of the mosque, Argha is also present. It was appealed in the petition that ASI survey should be conducted with the help of penetrating. Besides, the entire remaining premises, bathrooms and basements should also be surveyed. Let us know what decision the court has given on all these arguments.
Why was the petition rejected?
While giving the verdict, the court said that the claim of finding Shivalinga in Vajukhana has been preserved on the orders of the Supreme Court. Therefore, the Supreme Court has ordered to preserve the Shivalinga figure. Therefore, his ASI survey cannot be ordered. The court said that the report submitted in the ASI survey regarding Araji number 9130 i.e. Gyanvapi case is yet to be perused.
The Varanasi court said that the High Court and the Supreme Court have ordered that the ASI survey of the premises will be done only through non-invasive methods so that the existing structure is not damaged. The Hindu side has not been successful in explaining to the court why an additional survey of the Gyanvapi complex should be conducted. In such a situation, the petition filed for additional survey in the entire Gyanvapi campus was rejected.
will go to high court
Hindu side’s lawyer Vijay Shankar Rastogi said during a conversation with the media that he will now present his side before the High Court. While talking to the media, the lawyer of the Hindu side said that the court had ordered that a team will be formed by the ASI for the survey. This team will be made up of a total of 5 people. Besides, one person from a minority community will also be included in it. He said that earlier the survey conducted by ASI was not done by forming such a team.
He said that we had sought permission to dig a four by four foot trench to know the truth about the 100 feet Jyotirlinga. Without knowing the truth behind the Shivalinga-like figure found in the bathroom, the entire truth in this case will not be revealed. What is the relation of plot number 1930 which has been surveyed by ASI to 1931 to 1932?
Both the parties as well as the entire country were waiting for the decision to come after 33 years. Being a People’s Representative suit, all eyes were on the court of Judge Yugal Shambhu. Now the petition of the Hindu side in this matter has been rejected.
