The issue of reservation in Jammu and Kashmir reached the High Court, the petitioner said – amendment is unfair

After the outrage on social media in Jammu and Kashmir, the issue of reservation has now reached the Jammu and Kashmir and Ladakh High Court. Terming the new reservation rules for general category or open merit as an injustice, many handlers on social media also demanded removal of the new rules. In the first hearing on a petition filed in the High Court on Wednesday, the Court directed that any appointment made under the new reservation rules will be subject to the outcome of the petition seeking to declare the rules invalid.

The court was hearing a petition filed by 5 people. In this, a demand has been made to declare the amended reservation rules invalid. The court has sought assistance from AAG in the case on the next hearing. The petitioners argue that due to the amendment in the reservation rules of 2005 by the administration, the seats for government recruitment posts and open merit in educational institutions have reduced from 57 percent to 33 percent.

Reservation given by the Constitution should remain in force

The petitioner said, Residents of Backward Area (RBA) should be increased from 20 percent to 10 percent, Scheduled Tribe (ST) should be increased from 10 percent to 20 percent, Social Caste (Social Caste) should be increased from 2 percent to 8 percent and ALC (ALC) should be increased from 10 percent to 20 percent. 3 percent to 4 percent reservation has been given, PHC 3 percent to 4 percent reservation.

Petitioner Advocate Zahoor Ahmed said, considering the revised rules of reservation as unfair to the General Category or Open Merit, the members of the General Category Welfare Form say that the government should look into the matter. Reservation should be maintained as per the Constitution. So that those having open merit, whose population is more, also get their rights.

The government needs to look into this matter

According to General Category Welfare Form Chairman Aftab Ahmed Andrabi and Mukhtar Ahmed, this issue of reservation has been raised by political parties from time to time. So that we can make political gains on this. But, this is not a political issue but a humanitarian issue. Political parties have also started speaking on this matter. National Conference MP Agha Ruhullah is speaking against it. Whereas PDP MLA Waheed Parra is also joining his voice and speaking against these new rules of reservation.

Farooq Abdullah also talked about the issue of reservation and said that the government needs to look into this matter. It is also important to keep in mind that the reserved categories have been kept so that they can develop. PDP Chief Mehbooba Mufti has also reacted on this matter. Youth, who constitute 65% of the population, after surviving years of violence and protests, now face a new challenge in fighting for merit and justice in recruitment processes, he wrote in a post on ‘X’ .
