Such claims are an open mockery of the law… Ajmer Dargah controversy says Muslim Personal Law Board, appeals to CJI

All India Muslim Personal Law Board (AIMPLB) on Thursday expressed concern over the demand for survey of Ajmer Sharif Dargah. Also, the Chief Justice of India has been requested to take cognizance of the Ajmer case. AIMPLB said that Chief Justice Sanjeev Khanna should take suo motu cognizance of this matter. And it should be ensured that the local court does not open the way for such disputes further.

A case has been filed in the local court claiming that Ajmer Dargah is a Shiva temple. The court accepted it for hearing on Wednesday. Also, notices have been issued to Ajmer Dargah Committee, Ministry of Minority Affairs and Archaeological Survey of India (ASI) seeking answers. AIMPLB spokesperson said that such claims are an open mockery of the law and the Constitution.

There is no basis for such claims – Ilyas

AIMPLB spokesperson Syed Qasim Rasool Ilyas objected to this in a statement. He said, ‘The Personal Law Board expresses deep concern over the claims against mosques and dargahs in various courts across the country. Such claims are an open mockery of the law and the Constitution. He says that there is no basis for such claims under the Places of Worship Act 1991.

Syed Qasim Rasool Ilyas termed such claims as baseless. He said that in this law passed by the Parliament, it has been made clear that the status of any place of worship till August 15, 1947 will remain unchanged. This means that it cannot be challenged in court. Ilyas said that he has appealed to the CJI to immediately take suo motu cognizance of this matter.

It is the responsibility of governments to enforce laws – Ilyas

Rasool Ilyas said that Chief Justice Sanjeev Khanna should take cognizance of the case and take action. Also instruct the lower courts to refrain from opening the doors for any further disputes. He said, ‘It is the responsibility of both the central and state governments to strictly implement this law passed by the Parliament.’
