The bail plea of Lok Sabha MP from Baramulla and engineer Rashid, who is jailed in a terror funding case, was heard in Delhi’s Patiala House Court on Wednesday. The court postponed the matter without taking any decision on Rashid’s bail. During the hearing in the case, the investigating agency NIA told the court that the agency will write a letter to the Delhi High Court requesting that it hand over the power of the MP/MLA court to the special NIA court.
If the court allows this, then it will be easier for the investigating agency to investigate the allegations against Engineer Rashid. The investigating agency said that it would take 10 days to get a reply from the High Court, hence it requested the court to list the case for hearing. The next hearing of this case will be on December 5.
Demand to transfer MP/MLA to court
Since Rashid was elected MP, there is a demand to transfer the investigation of the allegations against him to the MP/MLA court. While hearing the same case, the Special NIA Court has recently sent the case to the District Judge so that transfer of the case to the Special MP/MLA Court can be considered.
Petition to attend session
The MP from Baramulla, Jammu and Kashmir had filed a bail petition to attend the winter session of Parliament. Rashid said in his petition that since being elected as MP, he has not been able to participate in the Parliament session. Being an MP, he has the right to participate in the proceedings of the House.
Engineer Rashid, who was in jail in several cases including terror funding, had got bail from the court to campaign in Jammu and Kashmir elections. However, after the elections were over he had to go back to jail. Rashid led Awami Ittehad Party had fielded candidates from many areas of the valley in the Jammu and Kashmir elections, but did not get success on any seat.
