Delhi High Court has reserved its decision on the bail plea of former AAP MLA Naresh Balyan. Balyan was arrested in the MCOCA case related to gangster Kapil Sangwan. He is in custody since December 2024. The lower court has rejected his petition.
New Delhi [भारत]July 28 (ANI): The Delhi High Court on Tuesday reserved its verdict on the bail plea of former Aam Aadmi Party (AAP) MLA Naresh Balyan in a Maharashtra Control of Organized Crime Act (MCOCA) case involving alleged gangster Kapil Sangwan alias Nandu.
Balyan was arrested in this case in December 2024. Justice Manoj Jain reserved the verdict after hearing the arguments of Naresh Balyan’s lawyer and senior advocate Amit Prasad, appearing for Delhi Police, and Special Public Prosecutor (SPP) Akhand Pratap Singh.
Instructions to Umed Singh to join the investigation
The bench has also asked Umed Singh to join the investigation of the case in the Crime Branch of Delhi Police by Friday. He had approached the court to stay his arrest and cancel the non-bailable warrant (NBW) issued against him.
Arguments of defense and prosecution in court
His lawyer had argued that Naresh Balyan is not involved in any crime or criminal activity. He had even filed a complaint against Kapil Sangwan alias Nandu.
During the arguments, Balyan’s senior lawyer argued that Delhi Police took the voice sample of Naresh Balyan and not of any other accused. It has not been established that the voice is that of Naresh Balyan.
Police presented this evidence
Delhi Police is reportedly relying on an audio clip of a mobile conversation between Balyan and Sangwan. He has also recorded statements of victims and protected witnesses against the syndicate. He has also recorded the confessional statements of Sachin Chikara and Rohit alias Anna.

Balyan is an accused in a MCOCA case linked to an organized crime syndicate allegedly run by Kapil Sangwan alias Nandu. Balyan is in custody since December 4, 2024.
Balyan had moved the High Court after the bail plea was rejected by the lower court.
The Delhi Police Crime Branch had filed a chargesheet in a MCOCA case against Naresh Balyan and several others, alleging that they are part of an organized crime syndicate run by gangster Kapil Sangwan alias Nandu, who is absconding and allegedly hiding in the United Kingdom. (ANI)
