What does the Constitution say?
Under Article 75 of the Indian Constitution, the President appoints ministers on the advice of the Prime Minister. If a minister resigns or is removed, he is simply out of the Council of Ministers. Unless he himself resigns from the post of MP or any anti-defection law, court punishment or disqualification rule is applicable to him, his MP membership cannot be cancelled. For example, if a teacher leaves the responsibility of ‘sports incharge’ in a school, it does not mean that he has been expelled from the school! He will continue teaching in the school, but the responsibility of the sports department will now go to someone else. Exactly the same thing applies to the posts of ministers and MPs.

- Any serious crime should be punished by the court.
- Action should be taken against changing party under anti-defection law.
- Remained absent from House proceedings without permission for 60 consecutive days.
- Is declared mentally unsound or bankrupt.
- Give up Indian citizenship or take citizenship of any other country.
