A police station court has given a surprising verdict in the rape case. The court has acquitted the accused of raping a minor. The 28-year-old man was accused of raping a minor on the pretext of marriage.

The court said that it seems that the relationship was consensual. Special Judge SP Aggarwal said that accused Samsher Rice Khan is accused of repeated rape under section 376 (2) (n). Apart from this, a case has also been registered against him under POCSO.

According to the defense, Khan and the victim lived in the neighborhood and were in a love relationship for a long time. The defense claimed that in November 2019, Khan lured the minor to an empty house and then raped her. When the medical test of the victim was done in January, everything came to light. Investigation revealed that the victim was 8 months pregnant.

The court found that there was a huge difference between the claims made and the evidence regarding the age of the victim. Overwriting was also done in the birth certificate of the victim which the mother presented in the court. The medical team claimed that the victim was 16 to 17 years old at the time of the incident. During the hearing, the victim had admitted that she liked the accused and had gone to meet him of her own free will. The court said that it seemed that there was a love affair between the victim and the accused and the physical relationship between the two was also consensual.

20 years imprisonment to the accused of raping a minor

In West Champaran, Exclusive Special Judge of Rape and POCSO Act Arvind Kumar Gupta, while completing the hearing of a case of rape of a minor girl on Thursday, sentenced youth Suraj Kumar to twenty years of rigorous imprisonment and also imposed a fine of Rs 85 thousand.

The special judge has also ordered the victim to be given an assistance amount of Rs 5 lakh under the Bihar Victim Compensation Scheme. Suraj Kumar, convicted in this case, is a resident of Bakhri Bazaar of Govardhana police station. Special Public Prosecutor Jaishankar Tiwari said that the incident occurred on January 19, 2024. A minor girl was playing in the village. Meanwhile, Suraj Kumar forcibly took her to the forest on a motorcycle and forcibly raped her. In this regard, the mother of the victim girl had lodged an FIR in Govardhana police station. While completing the hearing of this case through speedy trial, the special judge found him guilty under sections 363, 376 of the Indian Penal Code and sections 4 and 6 of the POCSO Act and sentenced him.
