A strange case has come to light from Chhatarpur in Madhya Pradesh. Where in the public hearing held by Additional Collector Milind Nagdeve in the Collectorate, an Assistant Manager got caught for laughing. The Additional Collector has issued a show cause notice considering the laughter of the Assistant Manager as indiscipline. After the notice of the Additional Collector went viral on social media, the administration officials are in a dilemma.
After this matter came into limelight, the Additional Collector says that the notice is a part of administrative activities. Acts like hooting will not be tolerated in government meetings. This matter is of 29th October. During the public hearing in the auditorium of the District Panchayat, Assistant Manager of e-Governance KK Tiwari laughed at something. Considering the laughter of the Assistant Manager in the meeting as indiscipline, the Additional Collector had issued a notice to him. However, retired SDM BL Mishra, an expert in law, says that laughing does not fall under the category of misconduct in the Madhya Pradesh Civil Services Conduct Rules.

The assistant manager said that he has replied to the notice. Krishnakant Tiwari, posted as Assistant Manager of e-Governance, told that during the public hearing, he was discussing with the concerned person sitting nearby. Meanwhile, ADM Milind Nagdeve’s eyes fell there. He felt that Krishnakant Tiwari was laughing at something. Whereas Krishnakant Tiwari says that he was just discussing.
Additional Collector Milind Nagdeve said that the notice is part of administrative activities. The notice issued to the Assistant General Manager of e-Governance has been given under administrative activities. Similar action was taken in the past also to maintain discipline in the meeting.
It is wrong to give notice for laughing
When retired SDM BL Mishra was talked about in this entire matter, he said that only in Rule 2 and 3 of Madhya Pradesh Civil Services Conduct Rules-1965, misconduct is mentioned, only then a notice can be issued. There is no such rule in misconduct that even laughing or speaking constitutes misconduct. Therefore this notice is not valid.
