There is a big good news for ANM in Bihar. Patna High Court has given big relief to ANM. Patna High Court has refused to reverse the decision of the single bench to reinstate ANM on the basis of marks. On Monday, the court rejected the appeal of the state government. With this decision of the High Court, the way has been cleared for the reinstatement of more than 10 thousand ANMs. The bench of High Court judges K Vinod Chandran and Harish Kumar had reserved its decision on this matter on April 18.
Let us tell you that earlier the single bench of Judge Mohit Kumar Shah had ordered that the reinstatement of ANMs should be done on the basis of marks. The notice of Bihar Technical Service Commission dated 19 September 2023 was canceled by the bench. While hearing the case, the court had said that the reinstatement of ANM will be under Rule 7 of Bihar Women and Health Workers (ANM) Cadre Rules 2018.
The government had made changes in the selection process
In fact, as per the earlier order of the High Court for the reinstatement of ANM, the state government had issued an advertisement for jobs on 10709 ANM posts. According to which the selection process of the candidates was started on the basis of ANM Rules 2018. Meanwhile, the government had amended the Rules 2018. After which a notice was issued to select ANM on the basis of written examination.
Government’s decision challenged in court
The government’s decision of this amendment was challenged in the High Court. The petitioner said that earlier the state government had said that the reinstatement on ANM posts would be done on the basis of marks. For which 60 marks were fixed for ANM course exam, 15 marks for higher course and five marks (maximum 25 marks) were fixed for the year for working in a government hospital of the state.
Were implemented from June 1, 2023
But suddenly the government changed the selection process. And the new rules were implemented from June 1, 2023. The responsibility of ANM examination was handed over to Bihar Technical Service Commission. Thousands of ANMs were shocked by this sudden change of the government. They expressed their displeasure over the government’s decision.
After which this matter reached the court and the hearing started. The single bench of Judge Mohit Kumar Shah had ordered that the reinstatement of ANMs should be done on the basis of marks. Against which the state government had appealed in the High Court. The court had reserved its decision in the last hearing. On Monday, Patna High Court has given its decision, which has brought great relief to Bihar Women and Health Workers (ANM) and the path has been cleared for their reinstatement.
