New Delhi: Delhi’s Rouse Avenue Court has given a big relief to Yash Yadav, arrested in the NEET UG paper leak case. The court has allowed Yash to appear in judicial custody for the NEET UG examination to be held on June 21. Apart from this, he will also be able to attend his sister’s wedding on June 22 in police custody.
Will Yash Yadav go directly to the examination center from jail?
- Yash has been arrested in the NEET UG paper leak case and is currently in judicial custody. He had sought interim bail of 15 days to appear for the NEET UG exam.
- Vacation judge Vishal Gogne, while accepting Yash’s application, directed the jail authorities to take Yash for custodial examination on June 21.
- Besides, on June 22, an order was also given to take her to the wedding venue in Farrukhnagar, Gurugram.
The court has also asked the jail superintendent to help Yash in downloading the admit card when it arrives on June 17, because the information about the exam center will be there on it.
Big court order on NEET accused
Vacation judge Vishal Gogne said, “It is true that there are serious allegations against the applicant of misrepresenting and selling confidential questions of the same examination in which he now wants to appear. But his rights as a student cannot be taken away just because he was not granted bail. Not giving him the opportunity to appear in the examination would amount to punishment.”
The Court further said that the eligibility, candidature and selection of any student is subject to the orders of the examination conducting body or competent authorities. The Court said, “In view of this, the Court finds that the applicant is entitled to appear for the examination on 21.06.2026.”
Will also give exam, will also go to wedding
- While allowing Yash Yadav to attend his sister’s wedding, the court said that it is expected that a brother will perform some rituals at his sister’s wedding. The court has no specific reason to prevent the applicant from fulfilling his obligations towards his family.
- The judge said in his order, “However, the investigation is still in its initial stage, a lot of evidence has to be collected and many other suspects are also under investigation. Hence, the court is not in favor of granting him interim bail.”
The court said that since the applicant’s lawyer had given the option of taking the examination and attending the marriage in custody, the court agreed to this. In this way the rights of the applicant will also be protected and the interests of the investigation will not be affected.
Court’s master decision amid NEET controversy!
- The Court has directed the Superintendent of Central Jail to produce the applicant Yash Yadav with full security at its examination center in Gurugram, Haryana on June 21 at 12:00 am, so that he can appear for the examination from 2:00 pm to 5:00 pm. He will be sent back to judicial custody immediately after the examination.
- Advocates Ambika Yadav, Kapil Yadav and Neha Yadav appeared on behalf of Yash Yadav. He argued that the right to education is a fundamental right and just because the applicant is an accused in the case, he cannot be stopped from appearing in the examination. He also said that it is a traditional requirement for a brother to be present at a sister’s wedding.
