After hearing the Jantar Mantar protest case in the Supreme Court, a big order has been passed. The bench of Chief Justice Surya Kant said in its order that no action should be taken against any protesting student.

Earlier in his remarks during the hearing, the Chief Justice had said that demonstrations keep happening in democracy. He said that there should be an independent and impartial investigation into the cases.

Big order of Supreme Court

The Supreme Court has given a big order regarding the NEET paper leak protest. The apex court has banned any harsh action against any student across the country. The court has ordered the immediate release of students below 18 years of age. However, protesters with criminal history will not get any relief. The court has said that all CCTV footage, drone recordings, wireless communications and other related records related to the demonstration should be kept safe. The court said that digital data and personal information of the protesting students will not be made public. The court has also issued notice to the Center and seven states. The Supreme Court said that a high level committee will be formed after knowing the views of the governments. The court said that it will conduct a completely impartial and transparent investigation into the recent incidents.

It is necessary to fix responsibility – Chief Justice

The Chief Justice said during the hearing that the law will take its course against whoever has committed atrocities. He said that its investigation should be completely impartial and independent. The Chief Justice said that if responsibility is not fixed then there is no point in investigation.

Pellet gun was mentioned

CJI Surya Kant said that there are some allegations in all the petitions. But if you look broadly, one allegation is the use of pellet gun, due to which a 19 year old boy lost his eyesight. There are allegations of use of electric baton. A girl was admitted to ICU. Allegation of threat to life due to use of sticks with nails. There is also a case of attack on a media person. He was brutally attacked. Then the police in civil dress allege violence. Another case in which a girl was slapped by a policeman without any provocation.

Government’s argument

Solicitor General Tushar Mehta appeared on behalf of the Central and Delhi governments. He said that the government is not taking the use of force on students lightly. In such a situation, action should be taken. But 250 policemen were also injured during this demonstration. The truth should come out after proper investigation. Chief Justice Surya Kant interrupted Mehta and said that that is why we want an investigation. Then Mehta said that I do not think that the students committed violence. Anti-social elements must have entered into it. He said that we will present the data of anti-social elements. He claimed that people who were involved in murder, rape and NDPS cases were involved in the protest.

The petitioner’s lawyer alleged that there were policemen in plain clothes also. He said that we have identified him. Petitioner’s lawyer Gopal Shankaranarayanan told the court that this is a matter related to the protests taking place across the country. Incidents took place in MP, Nagpur, Bihar, etc. He said that not only in Delhi, many incidents have been placed before the court.

Custody issue raised in Bihar also

Senior advocate Shadan Farasat said that the Bihar government has said that it is withdrawing the FIR. But more than 150 minors are still in custody. He should be released immediately. People remained in custody for more than 48 hours. Presented before the magistrate after 40 hours. A boy is only 13 years old.
