In fact, Jitendra Prasad, a resident of Kothia, had filed a complaint in the State Election Commission that Saba Khatoon has citizenship of Bihar as well as Nepal.

Jitendra Prasad, while giving information about dual citizenship under Section 135 and 136 (2) of Bihar Panchayat Raj Act 2006, had demanded the removal of Saba Praveen, who was the head till now, from the post of head. It is clear that under Section 136 (1) of the Bihar Panchayat Election Act 2006, it is mandatory to be a citizen of India to participate in the Indian election process.

After Jitendra Prasad made allegations, the State Election Commission had sought information about the situation from Saba Khatoon. On which Saba Khatoon told that after her father’s death, she had gone to her maternal grandfather’s house in Nepal for some time and soon returned to her ancestral home in Bihar. However, she could not answer that how the name, photo and voter ID card were released in the citizenship register of Nepal? He had also told the Commission that he has written literate in his nomination form, whereas he has passed the examination equivalent to Matriculation. He also told that his mother is a Nepali citizen and his father is an Indian citizen. After her mother’s marriage, she came to India to live, her father died in 2007, due to which she stayed in her maternal grandfather’s house in Nepal for a short time, but it was a very short-term stay. His ancestral home has been India since the beginning and all his family members and relatives including his grandfather are currently residents of Bihar.

In support of her claim, Saba Khatoon also got the photocopy and genealogy of Khatian of the year 1898 inspected by the State Election Commission. He also told the Commission that it is clear from the said plot and family tree that his ancestral family is an original and permanent resident of India. However, he also told the Commission that his mother Ahmadi Khatoon had participated in the Panchayat elections in the year 2016. Voter ID card is also available with them. From the beginning till now the people of his family reside in India.

In this regard, he also presented the certificates of Focania, considered equivalent to 10th, and Vastaniya, considered equivalent to 8th, issued by Bihar State Madrasa Education Board, Patna. It was also claimed that she has been a resident of India since birth.

He also told the Commission that as soon as he came to know that his name was included in the citizenship list of Nepal, he requested to remove it from there immediately. After this, on March 3 this year, his name was removed from the citizenship list of Nepal. He told the Commission that possibly due to his mother being a Nepali citizen, his name might have been included in the Nepali voter list and Nepali citizenship list under the provisions of the Citizenship Act.

Thus, despite having qualification under Section 136 (1) of Bihar Panchayat Raj Act 2006, he participated in the election on the basis of false affidavit while hiding the facts and won the post of Mukhiya Gram Panchayat Kothia District Darbhanga. Therefore, under the powers given under the relevant sections of Bihar Panchayat Raj Act 2006, Saba Praveen alias Saba Khatoon is relieved from the post of Gram Panchayat Mukhiya with immediate effect. At the same time, the Commission has also made it clear to the District Magistrate of Darbhanga that for hiding the facts and submitting false affidavit, under the provisions of relevant sections of Bihar Panchayat Raj Act 2006 and other relevant sections and despite not being an Indian citizen. Legal action required against Saba Khatoon for participating in the elections in India should be ensured under relevant sections.
