Court strict on GPI family tussle, summons in case of alleged attack

A Delhi court has summoned industrialist Bina Modi and senior lawyer Lalit Bhasin in the case of alleged assault on Godfrey Phillips India (GPI) executive director Sameer Modi. This matter is related to the incident that took place during the board meeting of the company on 30 May 2024.

Judicial Magistrate Anija Bishnoi, taking cognizance of the charge sheet, issued summons to Bina Modi, Lalit Bhasin and Bina Modi’s personal security officer Surendra Prasad. It is alleged that Surendra Prasad stopped Sameer Modi from entering the boardroom and allegedly assaulted him.

According to Sameer Modi, when he came to attend the board meeting, he was not allowed inside. He alleged that on the instructions of Bina Modi, Surendra Prasad stopped him and when he protested, he attacked him. In this incident, his right index finger was broken, after which surgery had to be done and screws and wires were inserted in it. In the medical report the injury has been described as serious.

The police had filed a charge sheet on March 1, 2025, in which it was said that there was sufficient preliminary evidence against Surendra Prasad. However, the police had said that there was not enough evidence against Bina Modi and Lalit Bhasin. After this, Sameer Modi filed a protest petition demanding that both of them be made accused.

Court said – Police opinion is not final

The court clearly said in its order that the magistrate takes cognizance of the crime and not just the opinion of the police. Even if the complainant was not called to the meeting, causing grievous hurt to restrain him is illegal. The Court held that the material on record prima facie indicates a conspiracy or common intention. Now the entire truth of the case will come out during the trial.
