High Court refuses to ban the new provision of reservation in Bihar, seeks answer from Nitish government – Khel Ja – Khel Ja

Patna High Court has refused to stay the decision of Bihar government to increase the reservation quota from 50 to 65 percent for the time being. However, the court has directed the state government to reply by January 12, 2024. A PIL has been filed by Gaurav Kumar and others regarding changes in Bihar reservation quota.

A division bench headed by Chief Justice K Vinod Chandran heard the case. Now the court will hear all the petitions filed in this regard together. The petitioner has argued that the law passed by the Bihar Assembly last month, in addition to the 10 per cent reservation for economically weaker sections, has increased the limit of reservation in government jobs and educational institutions to 65 per cent, which the law does not permit. . It is unconstitutional to do so.

On behalf of the petitioner, the Supreme Court’s decision in the famous Indra Sawhney case has been argued. In which the total limit of reservation was limited to 50 percent and it could be changed only in extremely exceptional cases.

The petitioner has described the survey as politically motivated.

Along with this, the petitioner has also alleged that Nitish Kumar’s government has taken this step only on the basis of increase in the population of backward classes, citing the caste survey. In the survey, the total population of OBC and EBC has been stated to be 63.13 percent. The petitioner has also described the survey as politically motivated.

Opposition had raised questions on caste survey

Let us tell you that BJP had made a big attack on the recent caste survey conducted by Nitish Kumar government in Bihar. Leaders of the BJP-led NDA, including Union Home Minister Amit Shah, had alleged that the government had inflated the numbers of Yadavs and Muslims while pursuing appeasement politics. However, Bihar Deputy CM and RJD President Lalu Prasad Yadav has denied BJP’s allegations.
