Delhi High Court refused to hear the PIL filed on the violence during the Cockroach Janata Party protest at Jantar Mantar. The court has given liberty to the petitioner NGO to approach the competent authorities and said that their memorandum should be considered as per law.
New Delhi [भारत]July 24 (ANI): The Delhi High Court on Friday declined to hear a public interest litigation (PIL) filed by NGO Save India Foundation seeking direction to Delhi Police to initiate criminal action against people allegedly involved in arson, attacks on policemen and damage to public property during the anti-CJP protest at Jantar Mantar on July 20.
However, a division bench of Chief Justice Devendra Kumar Upadhyay and Justice Tejas Karia gave liberty to the petitioner to approach the competent authorities and directed them to consider his memorandum in accordance with law.
The bench said, “We are of the opinion that in view of the law laid down by the Supreme Court with regard to damage to public properties and the 2018 judgment, we permit the petitioner to present his case before the concerned authorities. The memorandum will be looked into and an appropriate decision will be taken as appropriate under law. The decision will be communicated to the petitioner.”
What was the demand made in the petition?
The PIL had sought direction to Delhi Police to take immediate criminal action against those allegedly involved in the violence during the July 20 protests, including physical attacks on policemen and damage to public property. There was also a demand to recover the cost of the loss from those found responsible.
Serious allegations were made against the police
According to the petition, Delhi Police failed to take preventive steps despite receiving advance representations warning about the proposed gathering at sensitive locations in Central Delhi, including Jantar Mantar, Parliament area and India Gate. It was alleged that even after the violence, no effective action was taken against those responsible.
The plea further claimed that the July 20 protests led to chaos in parts of New Delhi, in which protesters allegedly attacked policemen, damaged public property and created panic around Parliament. It alleged that despite CCTV footage, news reports and social media videos being available, the police have failed to initiate appropriate action against the alleged culprits.
Save India Foundation also said that it had submitted a memorandum to Delhi Police demanding preventive measures ahead of the proposed protest and had approached the High Court ahead of the June 6 mobilization. However, he claimed that when the Court was informed that adequate arrangements had been made by the Delhi Police, the case was not listed immediately. (ANI)
