Recently, in a divorce case, the woman claimed in the Kerala High Court that her husband had no interest in sex and she only goes to the temple and ashram. Even her husband tried to make her spiritual like her own.
The court, while hearing the case, upheld the divorced order of the family court, which cleared the path of divorce between the husband and wife.
According to the ‘Bar and Bench’ report, the bench of Justice Devan Ramachandran and MB Snela said in the judgment, “Marriage does not give a partner the right to direct the personal beliefs of another spouse, whether it is spiritual or something else. Forcing the wife to live a spiritual life is nothing short of mental cruelty. This shows not to be interested in husband in family life and not to fulfill marital duties. ”
The court said that there is no reason that the wife’s claim is not believed. The court said that mental cruelty – which is the basis of divorce under Section 13 (1) (IA) of the Hindu Marriage Act, 1955 – that applies when the husband neglects his marital duties.
The couple did the court marriage in the year 2016. However, there was tension in the marriage after that. The wife claimed that all this happened due to a lot of religious practices of the husband. The wife said that her husband was not interested in having sex or having children. He used to go to the temple and the ashram only after returning from the office. Her husband was interested in this. At the same time, he tried to make his wife the same. He was also stopped from studying.
The woman first came to divorce in 2019, but later withdrew the petition, as her husband promised that she would change her behavior. However, after this, the wife again arrived in 2022 to divorce. She claimed that there was no change in her husband’s behavior. The family court agreed on the basis, which again divorced between the woman and the husband. The husband then approached the High Court and claimed that his spiritual practices were misunderstood. The wife did not want to have children before completing her post graduate. However, the court, after hearing both sides, upheld the divorce order.
