They have been suspended for the entire budget session.
Now the question is what is the process of suspension of an MP, which rights of the MP are lost after suspension and when will the MP be able to return to the House after this action.
When and how does an MP get suspended?
There is a general principle in Parliament that the job of the presiding officer i.e. the Speaker of the Lok Sabha and the Chairman of the Rajya Sabha is to run the House smoothly. For this he has also been given some privileges. If the proceedings are disrupted in any way, the Speaker or Chairman can ask any member of the House to go out. Can suspend them.
However, there are some rules for this also. Rule 373 of Lok Sabha proceedings says that if a member finds the conduct of any member unruly, he can direct him to leave the House immediately. Rule 374 says that action can be taken against a member who continuously disobeys the instructions of the Speaker or continuously misuses the rules by deliberately obstructing the functioning of the House. In such a situation, he can suspend the member from the House for the remaining part of the session. In the case of Rajya Sabha, a similar provision is recorded in Rules 255 and 236 of the Rule Book.The thing to be kept in mind here is that suspension occurs when the motion is passed by the House and the Speaker or Chairman gives the green signal to it.
How many rights are taken away from a suspended MP?
After suspension, many rights of MPs are curtailed. Know what those rights are.A suspended MP cannot raise issues of public interest in the House. They are deprived of the rights to hold the government accountable. They do not take part in debates on law and policy. The suspension serves to weaken his opposition role. That means they are not able to be a part of the proceedings of the House. In this way, suspension is considered a threat to the federal structure. He is not able to participate even in parliamentary committee meetings. Lose the right to ask questions. Cannot enter the chamber of Parliament (Lok Sabha or Rajya Sabha) during suspension.
How does suspension end?
Generally, suspension is for the day on which the Speaker or Chairman finds their conduct inappropriate or for the entire session in which the matter is related. In this way, when the session ends, the MP’s suspension automatically ends.
At the same time, if the suspension has to be ended in the same session, then a resolution for the same is passed by the House and the Speaker or Chairman gives the green signal to it. In this way the suspension of the MP ends and he can participate in the proceedings of the House.
