With the implementation of the new labor code in Uttar Pradesh, workers will get minimum wage, social security, double pay on overtime, night shift rights, gratuity in a year and legal recognition to gig workers. This will increase transparency in the employment system and industries.
Lucknow. Workers of Uttar Pradesh will now be assured social security, minimum wage and many new rights under the new labor laws. By removing the old 29 labor laws, four new labor codes have now been implemented, which include modern working style, pay system, health check-up and progressive provisions for gig workers. With these new laws, every worker will be guaranteed minimum wage, appointment letter, equal pay, social security, double pay on overtime, fixed-term gratuity and 100% health security in risk areas. Women have also been given the right to work in night shifts in a safe environment.
Reorganization of old laws and new code based on modern needs
Many labor laws in the country were enacted between 1930–1950, which did not mention gig workers, platform workers and migrant labourers. New labor codes provide legal protection to these modern working styles. The new laws in UP will give a modern look to the employment system and industrial system. Now more workers will come under the ambit of social security, which was not possible earlier.
Night shift for women and equal rights for transgender employees
Under the new legal provisions, women of Uttar Pradesh can work in night shifts with safety and consent. Along with this, women have been guaranteed equal pay and safe workplace. Transgender employees have also been ensured equal rights and protection at the workplace.
Appointment letter is mandatory and salary is guaranteed on time.
Now it is mandatory for employers to give appointment letter to every employee. Minimum wage has been implemented in the entire state and it will be a legal responsibility to pay the salary on time. Employees above 40 years of age will have a free health checkup once a year. Employees working in risky sectors like mining, chemical, construction will get complete health protection.
Gratuity benefit will be available only for one year’s service
Gratuity, which was earlier available after five years of service, will now be available only after one year of fixed-term service. This is a big benefit for private sector employees. Also, gig and platform workers have been given legal recognition for the first time. Ola-Uber drivers, Zomato-Swiggy delivery partners and other app-based workers will now get social security benefits. Aggregators will have to contribute 1–2% of their turnover to the social security fund. The benefits will continue even if you change the state if you remain linked to UAN.
Double payment of overtime and protection to contract workers
Now employees will get paid at double rate for overtime, which will increase transparency. Contract workers will also get minimum wage, social security and work guarantee. Migrant and unorganized sector workers will also now be included in the security structure. Single license and single return system will provide relief to companies from red tape and make the compliance process easier. The new Labor Code will lay a strong foundation in achieving the goal of “Developed Uttar Pradesh @2047” and will give impetus to Ease of Doing Business in the state.
