A new diesel automatic car purchased in 2019 became a cause of trouble for the owner. Within 34 months of purchasing the car, it started having electrical problems. The battery repeatedly discharged itself, due to which the car would not start.
Many visits to service center, still no solution
The car owner approached the service center several times. The battery was replaced 67 times and many electronic parts were also replaced, but the problem remained the same. The service team checked different parts of the car and even tried to find the cause by installing a data logger, but could not find a permanent solution.
Company denied manufacturing defect
The car manufacturing company said that there is no manufacturing defect in the car. His argument was that the customer did not present any technical or expert evidence in support of this claim. Also, the car had driven around 15,000 kilometres, which shows its usefulness.
Important decision of Consumer Commission
The Chandigarh Consumer Commission, in its decision on February 20, 2026, said that even if the manufacturing defect has not been proven, the same problem occurring again and again during the warranty period and making the customer continuously visit the service center is deficiency in service. The Commission acknowledged that this caused mental distress and inconvenience to the customer.
Rs 4 lakh compensation order
The Commission directed the car company and service center to pay compensation of Rs 4 lakh to the car owner and expenses related to the case within 45 days. If payment is not made within the stipulated time, 9% annual interest will also have to be paid.
Lessons for Customers
It is clear from this decision that if there are repeated problems in the new car, then customers can complain under their rights. Although strong technical evidence is required to get the car replaced or the money refunded, compensation for the continued inconvenience may still be available.
