Supreme Court Krishna Meditation: In the corridor re-development dispute associated with the famous Banke Bihari Temple in Vrindavan, UP, the Supreme Court on Monday recalled Lord Shri Krishna and said that Lord Krishna was the first mediator, trying mutual reconciliation. The court has also reprimanded the UP government for hurrying.
Court raises questions on the haste of UP government
A bench of Supreme Court Justice Suryakant and Justice Joymalya Bagchi questioned the Uttar Pradesh government’s plan to develop the corridor from the temple fund of Rs 500 crore which was approved without prior hearing. The court asked sharp questions and said what was this hurry to you? Why was a decision taken without listening to the temple trust? The Supreme Court also indicated to withdraw its old order given on May 15, allowing the state government to use temple funds.
Judicial committee will be formed
The court suggested that an interim committee should be formed under the chairmanship of retired High Court or District Judge, which will monitor the daily operations and development works of the temple. The court said that we will allow the interim committee to use the funds so that the safety and facilities of the pilgrims can be ensured.
Constitutional validity will be investigated
The temple trust can now challenge the Uttar Pradesh government’s ordinance in the Allahabad High Court. The court clarified that until the validity of the ordinance is confirmed, the state government can be prevented from interference in temple activities.
Court ultimatum to the state government
Additional Solicitor General KM Nataraj has been directed to reply to the government by consulting the government till 10:30 am on Tuesday morning.
Peeth Question: Temple no ‘No Mans Land’
During the hearing, Justice Suryakant said that the temple is not a ‘no man’s land’. Was anyone heard from the trust? Why was not a public notice not given? The court reminded that in May 2024 too, a bench of Justice BV Nagratna and Justice Satish Chandra Sharma had reprimanded the UP government for interfering in the private dispute. The court had said that if the state governments start interfering in private matters, then the rule of law will end. This is completely unacceptable.
2022 incident became the root of controversy
During Janmashtami 2022, a stampede -like situation was created in the temple, in which two devotees died. After this, in September 2023, the Allahabad High Court directed the government to form a corridor plan for mob management and security.
Injury to the faith of history and tradition?
The Banke Bihari temple, built in 1862, is managed by the Shebayat family, who has been taking over the responsibility of rituals and operations here for generations. The former trust management has alleged that the government took control of the temple without listening to them.
