The court not only refused to quash the FIR but also refused to stay his arrest. This case pertains to objectionable posts on social media against Prime Minister Narendra Modi, Home Minister Amit Shah and Bharatiya Janata Party (BJP) during the Pahalgam terrorist attack, after which Neha was accused of treason and inciting anti-national sentiments.

Poet Abhay Pratap Singh had lodged an FIR

The case against Neha was registered in Hazratganj police station area of ​​Lucknow, Uttar Pradesh. The FIR was lodged by national poet Abhay Pratap Singh, who alleges that Neha posted anti-national material and after that that material was shared in Pakistan also. It has been said in the FIR that through her post, Neha tried to disturb the peace and harm the unity of the country. Poet Abhay Pratap had described it as “an example of anti-national mentality”.

Lawyer Kapil Sibal said – Sedition sections are wrong

Senior advocate Kapil Sibal, appearing in the Supreme Court on behalf of Neha Singh Rathore, argued that serious charges like treason leveled against his client are illegal and unconstitutional. He said that “expressing a post or an idea cannot be treason.” Sibal also said that many sections have been added in the FIR without any basis and their aim is only to suppress the freedom of expression.

The Supreme Court gave a clear comment, said – the court cannot interfere in the investigation.

While hearing this entire matter, Justice J.K. The bench of Justice Maheshwari and Justice Vijay Bishnoi said that the FIR has been registered and the investigation of the case is going on, hence the court cannot interfere at this stage. The bench said that “the veracity of the facts recorded in the FIR is a matter of investigation and not of the court.” The Supreme Court rejected the petition, making it clear that there was no basis for granting relief to Neha.

Fear of arrest increased

After this decision of the Supreme Court, the possibility of arrest of Neha Singh Rathore has increased. At present she was demanding removal of only some sections in the case, but now the entire case is under the UP Police and the investigation is progressing rapidly. Legal experts believe that if the police get an unsatisfactory reply, he can be detained any time.
