Supreme Court is strict about maintenance of wife and daughter, money will be deducted directly from husband’s salary

The Supreme Court of India has said in an interim order that the husband’s employing company should deduct Rs 25,000 from his salary every month and send it directly to his estranged wife’s account through RTGS. This amount will be given for the maintenance of the wife and her minor child. According to the report, Justice J.B. Pardiwala and Justice K.V. Vishwanathan’s bench gave this order when it was found that the husband was not following the maintenance orders given earlier. He has been living separately from his wife since 2022 and during this period he did not even provide any financial help.

The wife is taking care of her four-year old daughter and has been living separately from her husband for a long time. She says that the husband did not give any money for the upbringing of the daughter and did not even come to meet the daughter for the last four years. The Supreme Court had earlier sent both of them for mediation, so that they could mutually agree to end the marriage by fixing a lump sum amount. At that time, while giving an interim order, the court had asked the husband to deposit Rs 25,000 for the travel expenses of the wife and daughter, so that they could attend the mediation. But he did not obey even this order.

Apart from this, the Magistrate Court had also ordered interim maintenance in 2024. Despite this, the husband did not make the payment and he had an outstanding of about Rs 1.38 lakh. When the Supreme Court saw his financial information, it told that his monthly salary is around Rs 50,000 and he is in financial trouble. The court asked him whether he was ready to deposit Rs 2.5 lakh including the dues, but he refused even this.

After this the Supreme Court said that in such circumstances it has no other option left. Therefore, the court ordered the husband’s employer to deduct Rs 25,000 from his salary every month and send it to the wife’s account through RTGS. The court especially expressed concern about the welfare of the minor child. The court also noted that after the death of the father, the woman has been living with her uncle and is raising the child alone. The next hearing of the case will be in April, in which the court will review compliance with its order.
