The Supreme Court on Wednesday expressed concern over the increasing trend of rape cases by falsely promising marriage. Justice MM A bench of Sundaresh and Justice Rajesh Bindal said that women should not make allegations of rape in romantic relationships and couples breakup cases.
He described it as the result of a conservative mentality. In this mentality, the man is blamed and there are flaws in our system.
The court made this comment while hearing the petition in which a person demanded dismissal of the rape allegations leveled by the woman. The woman alleged that the person had made physical relations with her by pretending to marry. On this, the court said that if the woman was so naive, she would not have come to the court. The woman was an adult and it is not possible that she was assured that the marriage would take place. Nowadays the perception of morality and virtues among the youth has changed. If the court had agreed with the woman, it would mean that every relationship between boys and girl in colleges would become a crime. For example, if the boy tells the girl to marry the girl next week and then refuses, will it be considered a crime?
Justice Sundaresh also said that the laws regarding marriage rights also need to be tested again, as under these rules the woman is forced to live with the husband, which cannot be right.
On the other hand, senior advocate Madhavi Dewan said that this case is not of love affair, but of a fixed marriage. In response, the court said that it does not matter. Tomorrow a woman can accuse her husband of marital rape. The court also commented that the woman herself enlisted the help of the senior advocate, which proves that she cannot be innocent.
