Bengaluru court has dismissed the sexual harassment case related to JDS leader HD Revanna. The court made the four-year delay in filing the complaint the basis of its decision. There is a time limit of 3 years for such cases under CrPC.
Bengaluru: A Bengaluru court has dismissed the sexual harassment case involving former Prime Minister HD Deve Gowda’s son and JDS leader HD Revanna. Additional Chief Judicial Magistrate K.N. Shivakumar acquitted Revanna saying that a delay of almost four years in filing the complaint could not be justified. This decision has come in the case registered against Revanna and his son Prajwal Revanna. Revanna had approached the High Court seeking dismissal of the case, which had directed the trial court to decide whether the delay in filing the complaint could be taken into consideration.
According to Section 468 of the Code of Criminal Procedure (CrPC), there is a time limit of three years for filing a complaint in offenses punishable with imprisonment up to three years. But in this case the complaint was filed with a delay of more than four years. The court found that the prosecution could not properly explain the reason for this delay. Therefore, the court made it clear that Revanna cannot be prosecuted under Section 354A. The case against Revanna and his son was registered on April 28 at Holenarasipura police station in Hassan district.
This FIR was registered on the complaint of a victim after thousands of obscene videos surfaced. Revanna was facing serious allegations like sexual harassment and kidnapping. He has already got bail in the kidnapping case. At the same time, Revanna’s son Prajwal Revanna, accused in several cases of sexual harassment, is still in jail.
