A plea has been filed in the Supreme Court, seeking a in the Asia Cup tournament and declaring the same as unconstitutional.
The petition, filed by Pune-based activist Ketan Tirodkar, stated that matches between India and Pakistan should not be held against the backdrop of the Pahalgam terror attack in May, which claimed 26 lives.
Tirodkar’s plea said that the match was in violation of Article 21 of the Constitution, which assures the right to life and personal liberty, including the positive right to live with human dignity for Indian citizens.
The plea sought issuance of an order or any other appropriate writ under Article 32 of the Constitution, directing the government to implement the National Sports Governance Act, 2025 and take the Board of Control of Cricket in India (BCCI) under the purview of the National Sports Federation (NSF) with its immediate effects.
The plea also sought that the BCCI be directed to register and adhere to the rules and guidelines set by the National Sports Board (NSB) established under the National Sports Governance Act, 2025.
It claimed that the India vs Pakistan match was “giving out an anti-national message to our forces and civilians that ‘we do not care for you'”.
“The said sporting event declared by BCCI is draconian and prejudicial to the interests of the nation, the armed forces and common citizens. Their rights are getting drastically eroded due to the adverse impact of the decision of BCCI to treat Pakistan sportingly as a friend worth playing cricket amid the series of killings of soldiers and citizens being carried out by Pakistani terrorists in the Kashmir Valley,” the plea said.
The petition will be heard by a bench headed by Chief Justice of India BR Gavai on Friday (September 12).
