She described this as a bitter truth and said that even though social and legal reforms have now led to marriage being seen as a partnership based on equality and respect, historically it has been used as a means of subjugating women.

Addressing a seminar on Cross-Cultural Perspectives, Justice Surya Kant said that across continents, cultures and eras, marriage has often been used as a tool to subjugate women. But now due to legal and social reforms, this institution is changing from inequality to a sacred partnership based on constitutional values of dignity, mutual respect and equality.
Legal framework created to protect women’s rights
She said that in India both the judiciary and the legislature have together created strong legal frameworks to protect the rights of women. Justice Surya Kant said that in earlier times in India, marriage was not considered a ‘civil contract’ but a sacred and permanent sacrament. In those times, family relationships were not governed by any written law, but by social and moral values.

Justice Surya Kant should also speak on cross-border marital disputes
He also talked about cross-border marital disputes. He said that the Supreme Court has laid down detailed guidelines for recognizing decisions related to foreign divorce or marriage. However, he made it clear that if any foreign decision is taken fraudulently or is against India’s principles of natural justice and the laws of the country, then it will not be recognized here. He also said that when children are involved in these disputes, the situation becomes more complex. In such cases, the Court should maintain co-operation between different courts, following the principle of “Committee of Courts”. But in every situation the interest of the child should be kept paramount.
