Jammu kashmir: The Supreme Court on Thursday, while hearing the petitions demanding to restore the status of the Union Territory of Jammu and Kashmir, said that the ground situation would have to be considered in the case of state status. A bench of Chief Justice BR Gavai and Justice of Justice said, “You cannot ignore what happened in Pahalgam.”

Tushar Mehta said- no time to spoil the atmosphere in Jammu and Kashmir

Solicitor General Tushar Mehta, appearing on behalf of the central government, said that the government had assured to give state status after the election, but there is a special situation there. Assembly elections in Jammu and Kashmir were held as per the promise made from the Constitution Bench. “This is not the time for the petitioners to spoil the atmosphere,” he said.

Petitions said- Central government did not fulfill promise

Mehta sought eight weeks to seek instructions from the government on this issue. The Supreme Court was hearing the petitions seeking instructions to restore the status of full state to the Union Territory of Jammu and Kashmir. It was said in the petitions that appropriate instructions were required to be passed to restore the status of full state in a timely manner as soon as possible, as the Government of India promised.

Petitions filed by college teacher Zahoor Ahmed Bhat and activist Khurshid Ahmed Malik said that despite the Solicitor General assured to restore the state status of Jammu and Kashmir, the Center has not taken any step in this regard in the years after the decision in Article 370 case.

The Constitution Bench had given the decision to remove Article 370 valid

Explain that on 11 December 2023, the 5 judges’ Constitution Bench unanimously upheld the legitimacy of the Central Government’s decision to cancel Article 370 of the 2019 Constitution. Told that Article 370 is “temporary provision”. The Supreme Court had noticed Tushar Mehta that the state-ruled region would be restored to the state status of Jammu and Kashmir, except Ladakh. It was directed that steps should be taken by the Election Commission of India to conduct the assembly elections in Jammu and Kashmir by 30 September 2024.
