Kashmir rape case: A court in Anantnag district of Jammu and Kashmir rejected the bail plea of Zubair Ahmad, accused of raping a 70-year-old woman in Pahalgam on Friday, 27 June.
The court refused to give any relief to the accused, calling the incident a symbol of sick mindset and moral decline of society.
70 -year -old woman was attacked by cruelty
The incident took place on 11 April, when a senior female tourist from Maharashtra (Maharashtra) stayed at the hotel in Pahalgam. According to the police, the accused entered the hotel room and raped her after seriously injuring the woman by pressing her face with a blanket.
The court rejected the arguments of the accused
Principal Sessions Judge Tahir Khurshid Raina (Principal Sessions Judge Tahir Khurshid Raina) said in his judgment: I do not find the arguments given by the accused to influence the judicial conscience so that his custody can be legally unconstitutional or unnecessary. The court dismissed the Supreme Court’s principle ‘bail rule, jail exception’ in this case, saying that leaving such an accused would be a wrong message for the society and it can become a Nazir.
Court expressed grief, raised big questions
Judge Raina said in a strict comment: This incident reflects the highest level of distorted mentality and moral decline in society. It highlights the need for intensive introspection on the moral values of the society. A senior woman, who had come to spend a few moments of her elderly life on this earth of saints and Sufis, happened to them that now they would regret the election of this place throughout their life.
Evidence increased grip against accused
The court also described the medical and forensic report as a strong evidence against the accused and said that the accused could not be ruled out of the absconding or the possibility of tampering with the evidence.
Defense arguments fail
Accused Zubair Ahmed had alleged that the victim did not identify her and she is giving full support in the investigation. But the court rejected this argument.
