A constable suspended due to gold between Duty has been given relief by the Karnataka High Court. The court says that it is very important to maintain sleep and work and life. Actually, some videos of KSRTC i.e. Karnataka State Transport Constable went viral, in which he is seen sleeping on duty.

He moved the court against the suspension.

Justice M Nagaprasan was hearing on the petition. He said that when the constable was done more than the time for a long time, he cannot be convicted of taking a nap. It is reported that due to lack of staff, the constables were shifting 16 hours instead of 8. The court has given them relief and ordered to return to service. Along with this, orders have also been given to give salary for the period of suspension.

Justice Nagprasann said, ‘If a person is asked to work more than his capacity, then many times the body needs sleep. Because in today’s time, sleep and work life balance is very important. Today is a constable, anyone can be there tomorrow. If a person will be deprived of sleep, then he will sleep anywhere.

The court also said, ‘If the petitioner would have slept during duty, it would have been wrong when they had to work in the same shift. In this case, the petitioner was made to work for 16 hours out of 24 hours for 60 days without a break…. The court also said that in the light of Article 24, everyone has the right to rest, including the work limit and holidays. The court has canceled the order of suspension of the constable.

Understand the case

Chandrashekhar, 33, was suspended in July 2024. He was found sleeping while on duty in April 2024 and his video also went viral on social media. He was then suspended by Kalyan Karnataka Road Transport Corporation. Now the constable has told the court that he was being worked out in double shift, due to which he was tired.

He also cited the vigilance report and said that the depot where he works is short of two-three personnel. He told the court that instead of keeping the staff, he was being asked to double shift again and again. He also said that he fell asleep after taking the medicine given by the doctor.
