Amit shah arrest case: The 130th Constitution Amendment Bill was introduced in Parliament. Under which if any Prime Minister, Chief Minister or Minister is arrested, then his chair will go away in 30 days.

This will be applicable in such criminal cases, in which there is a provision of punishment of more than 5 years. Home Minister Amit Shah introduced this bill. There was a lot of ruckus in the Parliament about this bill and Congress MP KC Venugopal reminded Amit Shah of his arrest, which happened many years ago. Let us know what happened then in Gujarat and when did Amit Shah resign.

KC Venugopal raised questions

Home Minister Amit Shah, while presenting the bill removing PM-CM, said that after the arrest, the leaders should leave their post showing morality. On this, Congress leader KC Venugopal got angry and said that this bill is going to destroy the federal system of the country. Can I ask the Home Minister a question that when he was the Home Minister of Gujarat, he was arrested. Did he follow that morality then?

On this allegation of the Congress MP, Home Minister Amit Shah replied and said that when I was the Home Minister of Gujarat, fake allegations were made against me and I resigned by showing morality. He said, ‘Even after coming out on the bell, I did not take any constitutional post until I was completely innocent from the court.’

In which case was Amit Shah arrested?

On the night of 26 November 2005, gangster Sohrabuddin’s encounter took place in Ahmedabad, Gujarat. Many types of questions began to arise about this encounter of Rajasthan and Gujarat Police. Sohrabuddin was first described as a terrorist, but later he turned out to be a gangster. Sohrabuddin’s wife was also killed after this encounter.

Amit Shah was also accused in this case itself. In the encounter case, Gujarat’s then Home Minister Shah and Rajasthan Minister Gulab Chand Kataria were named in the CBI charge sheet.

  • Before his arrest in this case, Amit Shah held a press conference in the BJP office and described himself as innocent and described the allegations as false.
  • Before being arrested, Amit Shah gave his resignation to the then CM Narendra Modi. Which was accepted. Ever since the name came in the case, the opposition was demanding his resignation.
  • Amit Shah was arrested on 25 July 2010 and was sent to 14 days judicial custody.
  • About three months later, on 21 October 2010, Amit Shah got bail. However, after this, he had to stay out of Gujarat for several months.
  • By 2014, 16 accused, including Amit Shah, Gulab Chand Kataria, were freed from the court and got a clean chit.

Government in preparation to enact law

The government is now preparing to enact a law to remove the leaders involved in corruption and criminal cases from the post. In the last few years, many such cases have been seen, in which even after the arrest of CM or Minister, he remained in his post. Arvind Kejriwal, who was the CM of Delhi, had run the government from jail itself. At present, the opposition is strongly opposing this bill of Modi government.
