Rajasthan High Court has given a big decision on live-in relationship. The court says that even if a boy and a girl are not of marriageable age, they can still live in a live-in relationship if they wish.
An 18-year-old woman and a 19-year-old youth from Kota had filed a petition in the Rajasthan High Court. While hearing this petition, Justice Anoop Dhand has given this decision.
The lawyer argued
The government lawyer present in the Rajasthan High Court said that the boy and the girl have not yet reached the age of marriage. The boy is below 21 years and the girl is also below 18 years. In such a situation, both cannot be allowed to live in a live-in relationship.
The court gave its verdict
Rejecting the argument of the government lawyer, the court said, everyone has the right to life and personal liberty under Article 21. In such a situation, any threat to the petitioner would be considered a constitutional violation.
According to the court,
Just by saying that the petitioner is not eligible for marriage, he cannot be deprived of his fundamental rights. Live-in relationship is neither illegal nor a crime under Indian law.
What is the whole matter?
This couple was living in a live-in relationship with mutual consent. According to the petitioner, the couple is in a live-in relationship since October 27, 2025. But, the girl’s family is opposing it. He has threatened to kill the couple. In this regard, the couple has demanded police protection.
The couple says that even after giving a written application to Kota Police, no action was taken. The court has ordered Bhilwara and Jodhpur police to provide security to the couple.
