In an emergency petition, Solicitor General John Sawyer urged the judges of the Supreme Court to take quick action. Said that it is very important to confirm the legal right of the President. It is necessary to solve the entire legal status of the President’s tariff as much as possible. The Trump administration has argued that the tariffs imposed on India will lead to peace in Ukraine.

The court had said- Trump encroached his authority

The request to the Supreme Court came a few days after a federal appeal court by 7-4 votes, stating that Trump used emergency powers to put tariffs on American business partners. In this way, he has encroached his authority. The court ordered the government to keep the tariff implemented by mid -October to give time for review.

Tariff on India will bring peace in Ukraine

The Trump administration has argued in its petition in the Supreme Court that the tariff against India will bring peace in Ukraine. These are “an important aspect of our efforts for peace” in Ukraine. Trump administration wrote,

The President has recently imposed a tariff against India for the purchase of Russian energy products to deal with the national emergency already existing in Russia’s war in Ukraine. This is an important aspect of his effort for peace in that war -torn country.

Why are the questions arising on the tariff imposed by Trump?

Trump has imposed a 10% basic tariff on countries trading with the US. Along with this, more tariffs have been imposed on countries like India and Brazil, which Trump believes that they are doing unfair business. Additional fees were also imposed on Canada, China and Mexico.

To justify these measures, Trump cited the International Emergency Economic Power Act of 1977. This allows the President to regulate the economy during the Emergency. The appeal court found that this law does not clearly include “fees or other similar things or tax imposing taxes.” In such a situation, questions are arising that what power Trump has used tariffs.
