Mental Cruelty Divorce: The Family Court of Jaipur approved a divorce by considering the baseless questions and taunts on the character of the husband in a 43-year-old marriage. This affected the dignity of marriage and mental peace.

Jaipur Family Court: Family Court-1 of Jaipur has approved the divorce of a couple living with 43 years. Judge Virendra Kumar Jasuja clearly stated that raising questions on the character of the husband or wife without evidence, abusive taunts and creating unnecessary stress in marital life falls under the category of mental cruelty.

Marriage in 1982 and divorce in 2021

The case is of a 67 -year -old man associated with administrative service, who filed for divorce in 2021. He told the court that the wife’s behavior had been derogatory since marriage in 1982. He said that the wife started taunting for the lack of small houses and means as soon as the in -laws came. He even said that not having a servant-train reflects his ‘poor mindset’. The husband alleged that the wife often doubted her character, publicly humiliated and also refused to sleep in the AC room.

Husband told the judge his painful story

The husband said in the court that these persistent derogatory behaviors mentally disturbed him so much that he had even given an application for voluntary retirement. However, the application was later withdrawn due to family agreement. Refusing all the allegations of the husband, the wife argued in the court that he never spoke, neither taunted nor made any quarrel. He said that the husband himself wants to live a life of rest and luxury, so he wants to get divorced by making baseless allegations.

Jaipur court told what is cruelty between husband and wife

After looking at the evidence and witnesses of both the parties, the court found that the wife’s allegations could not be proved, while the husband’s allegations were strengthened by the evidence. The court admitted that the allegations made unaware of the abusive behavior and character for years, mentally tortured the husband. On this basis, the court approved the divorce and said that “respect, trust and consent are necessary in marital relations. If any of these elements are constantly absent, it is called mental cruelty.” This decision has once again made it clear that the dignity and mental peace of each other is paramount in the husband-wife relationship. If there is constant insult and mistrust in the relationship, then the law does not hesitate to end such marriage.
