No relief to Muslim side in Somnath bulldozer action, SC said – Government will remain in possession of the land.

A hearing was held in the Supreme Court on Friday in the Gir Somnath bulldozer action case of Gujarat. During this time the top court refused to pass any order. The top court said that this is government land. The bench of Justice BR Gavai and Justice KV Vishwanathan said that the possession of the land will remain with the government till further orders and will not be allotted to any third party.

Presenting arguments on behalf of the Muslim party, Kapil Sibal said that these are protected monuments. No rights of any third party. On this Justice Gavai said what are the rights of third parties? This is government land. The High Court is aware of the matter. Sibal said that this is contempt of your order. Sibal said that the reason given for demolition is that those monuments are near the Arabian Sea and cannot be near a water body. Protected monuments were demolished. Can you imagine this despite your order?

On this argument of Sibal, Solicitor General Tushar Mehta said that there was no protected monument. Justice Gavai said that this order of the High Court was passed in 2015. You can use the land only for the stated purposes. Earlier, the Supreme Court had said that if our order is disobeyed then it will send the officers to jail. Gujarat High Court had also refused to give orders to maintain status quo.

Contempt petition has been filed in SC

On September 28, the Gir Somnath administration had bulldozed some places of worship, houses and graves of Muslims. A contempt petition has been filed against this in the Supreme Court. It has been said that even after the Supreme Court’s order to stop the bulldozer action, demolition work has been done on a large scale. Contempt action has been demanded against the Collector and other officials of Gir Somnath. The entire Patni Muslim Jamaat has filed a petition against the action of the administration.
