Now Aadhar card will not be valid for delayed birth certificate in Maharashtra. To prevent fraud, all old Aadhaar-only certificates will be cancelled. After investigating these cases, action will be taken against the concerned officers and applicants.

Mumbai: Now Aadhar card will not be considered as a document for getting delayed birth certificate in Maharashtra. A notice from the state revenue department said that after the Registration of Births and Deaths (Amendment) Act, 2023, all birth certificates made only through Aadhar card will be cancelled. The government has taken this decision to stop the use of fake birth and death certificates for illegal purposes. Revenue Minister Chandrashekhar Bawankule has ordered the cancellation of all suspicious certificates issued using Aadhaar cards. Till now, instructions have been given to take action against the officers who issued these certificates.

The 16-point verification guideline of the Revenue Department states that the orders issued by the Deputy Tehsildar after the amendment made in the Registration of Births and Deaths Act, 1969 on August 11, 2023, should be withdrawn, and the verification of the withdrawn order should be done at the level of the competent authority or the District Collector. The guideline states that since there is a need for immediate action on the pending applications in the state, all concerned offices should be checked and action should be taken as per the rules issued by the Public Health Department. Also, those which are not in accordance with this SOP should be immediately canceled and their entries on the Civil Registration System (CRS) portal should be removed immediately. As per the guidelines, Aadhaar card cannot be accepted as evidence for any subject or matter, and a complaint should be lodged with the police if any discrepancy is found between the Aadhaar number and the date of birth certificate while checking the pending application.

Birth certificates made at these 16 places in Maharashtra will be checked

The notice has flagged 14 areas where there are a large number of unauthorized births and deaths, including Amravati, Sillod, Akola, Sambhajinagar city, Latur, Anjangaon Surji, Achalpur, Pusad, Parbhani, Beed, Gevrai, Jalna, Ardhapur and Parli. All concerned tehsildars/police stations have been asked to “seriously investigate” these cases. After the order is given by the Tehsildars, all the concerned municipalities/municipalities should collate the records of delayed births.

Those who get birth certificate made from Aadhaar are no longer in good shape!

Many Tehsildar offices have issued birth certificates to applicants without any school certificate or any proof of date or place of birth, considering only Aadhaar card as proof. Orders given for delayed issue of birth certificate are wrong, and it is the responsibility of the Executive Magistrate or Tehsildar to reconsider such orders. The Executive Magistrate and Sub-Divisional Officer will have to make a list of these irregularities and give it to the police. A police complaint should be filed against such people. If only Aadhaar card is considered as the main proof for the original birth certificate, then the Tehsildar or Sub-Divisional Office has to submit the list of such people to the police station immediately. Also, a list of those people whose date of birth is different from the evidence given by the applicant will also have to be given. In a tehsil where no police complaint or FIR has been lodged, it is the responsibility of the tehsildar to register a case against the applicant for such discrepancies in the date of birth which amount to forgery or fraud.

The notice further states that for those birth certificate orders which have been cancelled, the Tehsildar and officials of the local self-government bodies should coordinate and take back all these original orders from the applicant. If this original certificate is not returned, help of the local police should be sought. The notice reads that the Divisional Commissioners have been asked to organize a one-day meeting under their chairmanship in coordination with the District Collector, all concerned Tehsildars, all concerned Municipal Corporations/Municipalities/District Councils/Police.
