Passport Citizenship Debate: The recent comment of the Ministry of External Affairs has once again intensified the debate regarding citizenship and documents in the country. The Ministry clearly said that the passport is not the final proof of citizenship, but is an international travel document, the purpose of which is only to make foreign travel easier. This issue came into focus when Supreme Court comments and public debates started raising questions on the legal role of documents like Aadhaar card, Voter ID and passport. What is passport and its real role
Passport is a government document issued for traveling abroad. In this, the identity and nationality of the person is recorded, so that other countries can grant him travel permission. This document plays the most important role in visa process, immigration check and getting assistance from Indian embassy abroad. But legally it is not considered the final proof of citizenship.
Difference between nationality and citizenship
A large part of the debate is about this difference. Nationality tells which country a person belongs to, while citizenship decides his rights and responsibilities in that country. On this issue, Congress leader Supriya Srinet and Rajya Sabha MP Kapil Sibal also said that passport cannot be considered as the final proof of citizenship. Writer and lyricist Javed Akhtar raised the question that when any document is not 100% proof of citizenship, then why is there no clarity about its role in the laws.
Is there any one citizenship certificate in India?
At present, there is no single final certificate in India that proves citizenship in every situation. Citizenship is determined based on citizenship laws and government records, not on the basis of any single document. This is why different documents are used for different purposes. Some for identification, some for voting and some for tax or travel related purposes.
Why identity documents are not proof of citizenship
Documents like Aadhar Card, Voter ID and PAN Card are mainly created for services and identification. Therefore, these in themselves are not considered conclusive proof of citizenship. This difference between the Passport Act and the Citizenship Act is the crux of this entire debate.
Cancellation of passport does not mean loss of citizenship.
Cancellation or suspension of passport does not mean that citizenship is lost. This may be for a number of administrative or legal reasons, while the process of revocation of citizenship is governed by a separate law. This entire debate has once again raised the question whether India needs a clear and unified documentation system for citizenship, or whether the existing legal framework is sufficient.
