A shocking case has come to light in Mumbai where the husband’s love became a problem for a woman. In fact, the person made his wife a joint owner of property worth Rs 6.75 crore, but the wife had to bear the brunt of this as an income tax notice.

The Income Tax Department considered it a possible tax evasion and the matter reached the Bombay High Court. Let us know how one can get caught in a tax case only by joining the property in the property.

Husband bought flat, wife only named name

According to the ET report, in the financial year 2020-21, the woman filed her income tax return, in which she showed her income only Rs 4,36,850. Despite this, the Income Tax Department sent a notice under Section 148 for the purchase of property worth Rs 6.75 crore.

According to the Bombay High Court’s decision, the husband bought a flat from HDFC Bank after paying the entire amount. He added his wife’s name as a joint holder only for convenience. Neither the wife put any money in the purchase of this flat nor did she have any financial contribution.

How did the case start?

According to the Economic Times, on June 21, the first notice was sent to the woman under Section 133 (6) by the Income Tax Department. In response to the notice, the woman said that she is a housewife and has paid the entire payment by her husband. But on September 18, 2024, the department again asked for documents. After this, in Mart 2025, the tax department issued a notice under Section 148. But in the end the matter reached the High Court and the Mumbai High Court ruled in favor of the woman on August 4.

Bombay High Court’s decision

The High Court said, “When all the documents are in front, it is out of understanding how the evaluation officer assumed that the wife had stolen the tax. The wife’s income was only 4.36 lakh rupees and he himself told that he did not take any part in the purchase of the flat.” Although the wife has got relief in this case, the notice issued against her husband is still pending and she will be heard in a separate case.
