Delhi High Court exposes Karisma Kapoor’s shifting will claims in stunning legal blow

New Delhi: The Delhi High Court saw a major development in the ongoing dispute over the will of the late Sunjay Kapur. Priya Kapur’s defence team strongly challenged the claims made by Karisma Kapoor and her children, exposing their case as based on speculation and contradictions.

The defence presented a detailed digital trail and multiple affidavits backing the authenticity of the Will, which Sunjay Kapur had executed correctly before his passing. This hearing added fresh clarity in this high-stakes inheritance battle involving assets worth thousands of crores.

 Defence disproves allegations against Sunjay Kapur’s will

On day three of the Delhi High Court hearing, Priya Kapur’s legal team systematically dismantled allegations brought by Karisma Kapoor’s children, challenging the will of their late father, Sunjay Kapur. The defence presented an unbroken chain of strong evidence, including digital records from the laptop of Nitin Sharma, who drafted and witnessed the Will, emails, metadata, affidavits, and travel logs. These records showed the Will’s creation, modification, and proper execution, eliminating claims of any forgery or tampering.

Key defence points included confirmation that the Will’s initial draft was based on a family template, explaining repeated typographical elements like the spelling of ”Azarias” and feminine terms. The defence also authenticated the timeline Sunjay Kapur personally reviewed and modified the Will between March 10 and March 17, 2025, contrary to the plaintiffs’ suspicion. The final signed PDF was circulated by Sunjay himself via email and family WhatsApp groups, with metadata-backed timestamps supporting every step.

Furthermore, the defence noted a contradiction: the plaintiffs accepted Sunjay Kapur’s signature on a Trust Deed worth Rs 2000 crore, but questioned the same signature on the Will only now. Affidavits from both attesting witnesses, Nitin Sharma and Dinesh Agarwal, confirmed the signature’s genuineness. There was no evidence of Will suppression, or irregular custody emails showed the executor was contacted immediately after Sunjay’s passing, and the original Will was formally handed over in June 2025.

No disinheritance, no improper benefits

Regarding financial claims, the defence pointed out that the Will does not disinherit the children, who already hold substantial beneficial interests under the RK Family Trust. The Will only covers Sunjay’s residual personal estate, including his 6.5 per cent share in AIPL and some overseas properties.

The defence dismissed allegations of pecuniary benefits to witnesses, noting that both witnesses held respected positions without material gains—the appointment of Nitin Sharma as a non-remunerated director was honorary. They rejected claims that Priya Kapur was removed from directorship due to personal reasons. Corporate filings showed she ended her role as Managing Director of Aureus Investment as part of routine restructuring in 2023 and continued serving as a Non-Executive Director at Sona Comstar by proper shareholder approval.

 Sunjay Kapur’s business legacy

The defence also highlighted Sunjay Kapur’s leadership legacy in reviving Sona BLW from near insolvency. Before Sunjay’s involvement, the company was burdened with $120 million in debt, outdated machinery, and losing a major customer, which slashed revenues by $25 million. After emergency financial measures and shutting down the loss-making U.S. unit, causing an $18 million write-off, Sunjay pivoted the company towards EV driveline technology. Under his vision, Sona BLW grew into India’s largest EV components manufacturer, supplying parts to one in every eight electric vehicles worldwide.

“The evidence leaves no room for speculation,” the defence said. “The will was executed with integrity, and Priya Kapur has consistently upheld Sunjay’s wishes, even spending over ₹1 crore on the education and welfare of the children.” The next hearing is scheduled for 21 November 2025, as the court continues to examine this complex legal battle.
